General / Scope of application

These General Terms and Conditions of Business apply to all types of orders (online shop, e-mail, telephone, EDI). Deviating or supplementary provisions, as well as verbal agreements or conditions of a customer are only recognised if they are confirmed in writing by Espressa GmbH.

Deliveries and shipping costs.

Deliveries are made exclusively to Switzerland and the Principality of Liechtenstein. As a shipping partner, Espressa GmbH works with the Swiss Post as a shipping service provider.

Pick-ups are possible after selected shipping method ‘Click and Collect’. If one or more items are not available in stock and have not been marked as ‘out of stock’ in the online store, a message will be sent to the customer, the goods will be delivered immediately or a full refund will be given.

Shipments are usually processed Monday through Friday by 6:00 p.m. and sent the same day. Excluded are holidays. Espressa GmbH hands over the parcels to Post AG; Espressa GmbH cannot be held responsible for delays in delivery caused by Post AG (traffic jams, storms, delivery problems). Espressa GmbH endeavours to deliver the goods as quickly as possible; Espressa GmbH can be contacted as an intermediary between the customer and Post AG for delays. Espressa GmbH differentiates between the following delivery methods:

Economy-Postpac: Orders are usually shipped by 6:00 p.m. on weekdays. Delivery takes place within 2 weekdays. Shipping costs are CHF 9.90, but are free for orders over CHF 59.00.

Priority-Postpac: Orders are also shipped by 6:00 p.m. on weekdays, with delivery within 1 business day. Here, too, shipping is free for orders over CHF 59.00, while it costs CHF 9.90 for orders under this amount.

Please note that we only ship to Switzerland and Liechtenstein.

Prices, discounts and Payment 

Prices, discounts and payment All prices are quoted in Swiss francs (CHF) and include the statutory value added tax. Espressa GmbH reserves the right to change or adjust prices and discounts without prior notice. The price at the time the contract is concluded shall apply.

Payment of the order is made by purchase on account (Powerpay.ch) with this payment option you accept the terms and conditions of Powerpay.ch below with link AGB Powerpay.ch also MF-Group AGB's.

You will receive the invoice by e-mail and then by post. Payment for the order is made by credit card (Visa, Mastercard, American Express), Twint or Paypal. We will confirm receipt of your payment with the order confirmation.

As a B2B customer, you will receive the invoice from Espressa GmbH by e-mail with a payment deadline of 10 days. We reserve the right to carry out a credit check before activating the B2B invoice payment method for you.

We transmit all payment data to Wallee, which manages its servers in Switzerland. Espressa GmbH is obliged to keep up to date with the latest encryption and security standards.

Warranty provisions

The statutory warranty applies to coffee machines and accessories. Food products are excluded from the guarantee, although Espressa GmbH will replace and take back products free of charge in the event of a batch defect.

Images and product descriptions

Espressa GmbH endeavours to always display up-to-date product images. In individual cases, there may be deviations between product images and the actual product. The product descriptions may be derived from original product texts. The product descriptions are written truthfully and according to the motto "to convey authenticity" and according to our own tests.

Retention of title for invoicing

If payment on account is selected, Espressa GmbH retains ownership of the goods until full payment has been made.

Exclusion of liability

Espressa GmbH accepts no liability whatsoever for loss or damage of any kind. Direct and indirect consequential damages are also excluded.

Liability

Espressa GmbH is subject to liability for damage to products caused during transport. Likewise for products that were not delivered by Post AG (parcel loss). In order to make use of this liability, the consignment tracking of the Post AG is considered a conceivable indication of loss or damage.

Right of cancellation

We grant a right of cancellation for orders placed via the sales channels listed in section 1. Cancellation must always be made in writing by letter post or e-mail to Espressa GmbH within 14 days of receipt of the goods.

The date of delivery or the time of handover to Post AG shall be decisive for compliance with the deadline. The cancellation should be addressed to: Espressa GmbH - Birchwiesstrasse 4, 8114 Dänikon or to [email protected].

By exercising the right of cancellation, we convert the purchase contract into a return relationship, according to which the items received as part of the purchase contract must be refunded. In the event of cancellation, the customer is requested to return the goods to Espressa GmbH immediately and in their original packaging. The costs for returns are generally to be borne by the customer.

Upon receipt of the goods, we will immediately arrange for an inspection and refund the purchase price for the item. We reserve the right to deduct an amount from the refundable purchase price in the event of damaged goods or excessive wear and tear.

Copyright

We reserve the copyright and the sole right of use. This applies to platforms such as the online shop and social media channels or advertising measures operated by Espressa GmbH. 
The content, texts and images are protected by copyright unless they are owned by third parties. The copying of texts and images requires written consent.

Data protection

We attach great importance to your data. You can find out more about our data protection provisions under Data protection. Our provisions are always adapted in accordance with Swiss law.

Applicable law and place of jurisdiction

Swiss law (OR) shall apply exclusively. The place of fulfilment for both contracting parties is 8157 Dielsdorf.
